INTERNAL RULES FOR VISITORS GALLERIA BURGAS SHOPPING CENTER

1. Introduction

GALLERIA BURGAS EAD is the owner of the Galleria Burgas Shopping Center situated at 6 Yanko Komitov Street, city of Burgas (hereinafter referred to as the “Owner” and the “Shopping Center,” respectively).

The Shopping Center operates in accordance with the provisions of these Internal Rules for visitors (hereinafter referred to as the “Rules”) establishing requirements to be complied with by all visitors of the Shopping Center in order to ensure the optimal functioning of the commercial activity and the efficient use of the facilities of the Shopping Center.

“Visitor” shall mean any person having access to the Shopping Center, regardless of his/her capacity, including but not limited to customers of trade outlets, staff, authorized representatives, and others

As the Shopping Center aims to ensure a nice and safe atmosphere for its visitors the latter shall be obliged to comply with these Rules.

By accessing the Shopping Center the visitors confirm and accept that they have made themselves familiar with these Rules and that they shall comply with all instructions and provisions of the Rules as their access to the Shopping Center is only permitted subject to compliance with the requirements included in these Rules, without any limitations and reservations.

These Rules shall apply for the visitors of the Shopping Center which is private property, open to the public, in all of its areas (including but not limited to the internal and external parts of the Shopping Center, the carpark, the green lawns, streets, and pedestrian alleys of the Shopping Center).

Galleria Burgas Shopping Center reserves its right to restrict its visitors, deny access, or remove from the Shopping Center any visitors who fail to comply with these Rules.

The visitors shall be responsible for direct and indirect damages caused to the Shopping Center, the Owner, its employees and associates as well as to other visitors.

The Shopping Center is a monitored site under video surveillance in view of the safety of its visitors in accordance with the provisions of the Private Security Guard Activity Act, and this is indicated by special signboards at the entrances and within its perimeter.

The Owner of the Shopping Center has the right to unilaterally change the Rules whenever he deems necessary.

The Rules are available at the Information desk and in the administrative office of the Shopping Center and on the website: www.galleriaburgas.bg.

2. Working Hours of the Shopping Center

The working hours of the Shopping Center and/or of individual outlets in it are indicated at the entrance of the Shopping Center and are available on the website www.galleriaburgas.bg.

The access of visitors to the Shopping Center outside of the working hours is prohibited except for the people for whom such access is explicitly stipulated.

3. Access to the Shopping Center

3.1. Access to the Shopping Center shall be prohibited for:

а) persons aged under 14 years non-accompanied by an adult;

b) persons with disabilities or diseases that make them vulnerable at public spaces if they are appropriately accompanied;

c) persons under the influence of alcoholic drinks, narcotic drugs, hallucinogenic substances, narcotic substances, etc.;

d) persons wearing indecent, inappropriate clothes or attire that encourages or contains discriminating symbols (fascist, racist, xenophobic, etc.);

e) persons who incite violence or encourage discriminatory messages of any kind, e.g. racist or xenophobic messages;

f) persons with indecent or aggressive behavior that violates the order and peace of the other visitors;

g) persons who have visited the Shopping Center before, and who have caused various incidents during their preceding visits such as: theft, destruction, threats, indecent, aggressive conduct with respect to visitors and/or employees of the Shopping Center, violation of the order and peace of the other visitors, incitement or fuelling conflict situations, or who have behaved inadequately.

h) persons carrying any weapons, ammunitions, sharp objects, except for officers of public authorities or authorized security guard employees;

i) persons carrying narcotic drugs, toxic, explosive, flammable, irritating and tear-gas materials or substances or other materials/substances deemed dangerous by the legislation in force, except for officers of public authorities or authorized security guard employees;

j) persons with bicycles, scooters, rollers, sleighs, skateboards, or other means of transportation (unless they carry them in hand during their entire visit), except for people with disabilities or people who move with difficulty, or authorized persons used for interventions or monitoring of the Shopping Center;

k) persons with pets, save for dogs used to assist blind people or watchdogs used by the security services/security guards as well as visitors of the pet shop where they move along the route indicated for that purpose;

l) persons carrying games/toys/equipment that may disturb the safe passage of the other visitors;

m) visitors outside the working hours of the Shopping Center, except for the persons for whom such access is explicitly stipulated.

3.2. In al parts of the Shopping Center the visitors must:

а) comply with all rules, guidelines, and prohibitions mentioned on the special signboards and safety requirements stated in the the Shopping Center as they shall bear the full responsibility in case of failure to do so;

b) throw away packaging, chewing gum, leftovers, cigarette butts, and any kind of garbage only in the special bins or ashtrays intended for that purpose;

c) not make dirty the Shopping Center;

d) prevent and abstain from making or causing strong vibrations or noise by screams or other disturbing sounds or by using loudspeakers, telephones, toys, or other audio/video equipment with high level of sound unless in cases of concerts or events permitted or organized by the Shopping Center;

e) avoid and abstain from actions that may cause dust, smoke or smells that may affect other visitors;

f) avoid and abstain from any actions that may threaten the life or health, their own or other visitors’, including but not limited to: leaning or bending down over rails, windows, balconies, terraces, blocking or attempted blocking of automatic doors, elevators, escalators, etc.

g) not leave personal belongings unattended. The Shopping Center shall bear no responsibility for their safety and integrity. The left baggage shall be taken out and destroyed within 7 calendar days if the owner fails to appear to collect it at the Information desk or in the administrative office of the Shopping Center.

3.3. In all parts of the Shopping Center the following actions shall be strictly prohibited as the list is not exhaustive:

а) access of visitors to any spaces other than public places (spaces) of the Shopping Center, including but not limited to: warehouse premises, areas for waste pressing, ramps for access of automobiles, economic buildings or technical premises, corridors, and areas for supply, areas marked as “Access of unauthorized persons is forbidden”, “Entry of unauthorized persons is forbidden” as well as in any other administrative areas where access is allowed to authorized persons only;

b) access of visitors to the exterior stairs intended for repair works and to the roof of the building;

c) use of escalators by means of baby-carriages or other special equipment/devices used by disabled people or people who move with difficulty. As regards baby-carriages it is prohibited to use them on escalators irrespective of whether the child is inside the baby-carriage or not, or whether it is carried in the hands, during the use thereof;

d) smoking in areas other than the ones specially arranged for that in accordance with the Healthcare Act and the applicable Bulgarian legislation;

e) scratching, writing, painting, staining by any substances, dismantling, moving, breaking, damaging or destroying of furniture (benches, tables, chairs, dustbins, etc.) as well as any installations, facilities, structural or decorative elements of the Shopping Center;

f) audio and video recordings as well as professional taking of photographs without the prior written consent of the management of the Shopping Center;

g) dissemination of advertising materials, providing of any kind of advertising or market research activities (dissemination or display of fliers, leaflets, and other advertising materials, conducting market research, questionnaires, interviewing visitors, fund raising, collecting signatures, etc.) without the prior written approval of the management of the Shopping Center even if the advertising materials are disseminated free of charge;

h) displaying advertising materials without the prior written consent of the management of the Shopping Center;

i) events or gatherings of political or religious nature;

j) begging, selling or collecting products of any kind, protests, biddings, tastings, exhibitions, show programs, organizing of charitable events, artistic performances (by actors, orchestras, choirs, acrobats, dancers, etc.), improvisations, flash mobs, games or any other events intended for an audience, without the prior written permission of the management of the Shopping Center;

k) discussions in loud voice, obscene words, offensive phrases or threats, aggressive conduct;

l) consumption of narcotic drugs, intoxicating or hallucinogenic substances as well as alcohol except for the outlets in the eating area that sell alcohol or outlets offering tastings;

m) actions causing damages (including image damages) to the Shopping Center and the tenants present therein, boycotting of their operation, promotion of third parties/competitors of the Shopping Center or the tenants present in the Shopping Center, including but not limited to creation of groups showing common messages (T-shirts, banners, advertising signs, etc.);

n) staying in the Shopping Center after the close of trade operation in the respective area;

o) lighting fire;

p) use of means of transportation (including but not limited to roller skates, rollers, skateboards, sleighs, scooters, bicycles, motorized or electric means of transportation of any type), except for baby-carriages or special traveling equipment/devices for disabled people or people who have moving difficulties;

q) peddle sale of goods without the written consent of the management of the Shopping Center;

r) ball games, drones, or other similar activities that may threaten the safety of other visitors;

s) blocking/obstructing the access roads or safety doors and corridors for emergency exits in any manner whatsoever such as, by way of example but not limited to: materials, voluminous objects, small objects that may be an obstacle for the visitors, by placing a large number of people in front of doors/corridors, etc.;

Visitors who fail to abide by the above provisions shall be taken out of the Shopping Center.

3.4. Rules applicable for minors and juveniles

“Juvenile” means a person who has attained the age of 14 but has not attained the age of 18 years.

For all minors (persons under the age of 14 years) and juveniles (persons having attained the age of 14 but not having attained the age of 18 years) the responsibility for the damages or accidents caused by them as well as for compliance with the Rules shall rest on their parents or, respectively, by their plenary or partial guardian even if the parents/plenary or partial guardian do(es) not accompany the child.

The parents or the companions shall be directly responsible for the safety and oversight of the children and shall be obliged to comply with the instructions and the rules on children’s safety.

The owner of the Shopping Center shall not be responsible in any circumstances whatsoever for the actions or damages done or caused by minors or juveniles, or for damages suffered by them, including accidents of any nature and at any place in the Shopping Center (including in the carpark), including as a result of lack of oversight or inadequate oversight of them. The owner of the Shopping Center shall have no legal obligation to oversee minors or juveniles.

3.4.1. Access and oversight of minors or juveniles

а) The access of minors or juveniles under the age of 14 years unaccompanied by an adult companion shall be prohibited.

b) If there is any doubt as to the age the security guards in the Shopping Center shall have the right to demand an original valid identity document with a photograph to be produced as well as to restrict the access of persons under the age of 14 years unaccompanied by an adult. The failure to produce a valid identity document that contains a photograph of the person in order to prove his/her age shall result in restriction of such person’s access in such situation.

c) The identity document shall be produced only for a visual check of the age. The owner of the Shopping Center shall not keep, record, copy or store the produced documents in any way whatsoever.

d) At any time while in the Shopping Center the juveniles under the age of 14 years must be duly and constantly overseen by the adult who accompanies them. The owner of the Shopping Center shall not be responsible for any injuries suffered by them.

e) It is recommended that the children under the age of 2 years remain in their baby-carriage or be held by an adult during their entire visit in the Shopping Center.

f) It shall be strictly prohibited to leave minors without supervision in any area of the Shopping Center (such as for instance but not limited to: near rails, stairs/escalators, elevators, closets/wardrobes, near the toilets, at the exterior terraces, near the ventilation nets and others, or in the outdoor and/or the indoor carpark of the Shopping Center).

3.5. Waste Management

а) The visitors of the Shopping Center must throw their own waste in the places specially designated to that purpose in the Shopping Center.

b) It shall be prohibited to throw away any waste (including but not limited to cigarette butts or chewing gum) outside the places specially designated to that purpose.

c) It shall be prohibited to burn waste of any kind in the premises (internal or external) of the Shopping Center.

3.6. Carpark

а) The carpark connected to the Shopping Center is intended to be used by visitors and authorized persons.

b) The visitors who use the carpark of the Shopping Center shall comply with the traffic and parking rules stipulated in the Rules on the organization and operation of the carpark of the Shopping Center, otherwise they shall be imposed the relevant sanctions.

4. Fire Safety and Protection

a) The improper use or damaging of fire alarm or fire extinguishing devices in the Shopping Center shall be strictly prohibited.

b) The administration and the owner of the Shopping Center shall not be responsible for incidents caused by visitors’ error, carelessness or negligence.

c) It shall be absolutely prohibited to block/impede in any way the access to or the evacuation ways, or the safety doors and corridors for emergency exits, respectively; they must remain free at any time in order to allow for the visitors’ safe entry and exit.

d) In case that the access ways, emergency exits are blocked or that the operation of fire extinguishing equipment is improperly intervened with the guilty person shall bear responsibility and the consequences of such actions.

e) These Rules may be modified at any time in order to be brought in compliance with the applicable demands.

5. Security in the Shopping Center

а) The security services within the Shopping Center shall be provided by specialized security guards appointed to that end by the Owner, or by a contractor hired by the Owner, including by way of installing and monitoring of images taken by video surveillance cameras.

b) By accessing the Shopping Center, subject to compliance with the Personal Data Protection Act and Regulation No. 679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the visitors express their consent to Owner’s or his subcontractors’ use of any piece of video evidence necessary for the clarification, settlement and/or proving of any incident having happened in the Shopping Center.

c) The authorized staff of the Owner may demand the identification of any visitors who violate or harm the operation of the Shopping Center and/or other visitors who behave improperly, visitors who may harm the commercial interests of the Owner and his staff contrary to these Rules.

d) For the reasons specified in the preceding item the Owner reserves his right to restrict or prohibit the access of certain persons to the Shopping Center subject to compliance with the applicable provisions of the law.

e) The security staff determined by the Owner may at any time proceed to physical control in justified cases and in accordance with the applicable provisions of the law.

f) The visitors shall be obliged to comply, at any time, with all instructions or directions they receive from the security staff, fire safety staff and the staff of the Shopping Center.

g) The staff of the Owner or the contractor hired by him for security guarding shall be authorized to intervene in order to ensure that these Rules are complied with.

5. Sanctions in case of failure to comply with the provisions of the Rules

а) Any visitors who cause damages as a result of a failure to comply with these Rules, to the Shopping Center, the Owner, his staff, in any form whatsoever, by their actions or omissions, directly or indirectly, must recover the respective damages in full, including but not limited to the costs for repair or replacement of damaged goods, facilities and objects, and shall respectively bear civil and/or criminal liability in accordance with the applicable provisions of the law.

b) In the event of failure to comply with any of the provisions of these Rules, the Shopping Center reserves its right to accompany the visitors in question to the exit and to immediately remove any material and/or object that is harmful, threatening or non-compliant with these Rules and the societal norms at the expense of the violator.

c) The Shopping Center shall notify the competent authorities in case that any actions and/or omissions contrary to these Rules, the owner’s instructions and the applicable provisions of the law are found.
